SwiftSites Referral Portal – Affiliate Program Terms of Service

1. Introduction
By registering as an affiliate in the SwiftSites Referral Program (“Program”), you (“Affiliate”, “you”, “your”) agree to be bound by these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you and SwiftSites Limited (“SwiftSites”, “we”, “us”, “our”).
SwiftSites reserves the right to update, amend, or replace these Terms at any time. Any changes take effect immediately upon publication in the Referral Portal. Continued participation in the Program constitutes acceptance of the revised Terms.
2. Eligibility
- You must be at least 18 years of age.
- You must reside in Ireland or another member state of the European Union.
- You must be a natural person or a legally registered business entity.
- Automated registrations, bots, or scripted signups are strictly prohibited.
- Only one affiliate account is permitted per individual or legal entity.
3. Account Registration & Security
You must provide accurate, current, and complete information during registration, including your legal name and a valid email address.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. SwiftSites accepts no liability for losses resulting from unauthorised account access.
4. Affiliate Approval & Status
All affiliate applications are subject to manual review and approval by SwiftSites. We reserve the right to approve or reject any application at our sole discretion.
Affiliate accounts may have one of the following statuses: Pending, Active, or Suspended.
Only Active affiliates are eligible to earn commissions.
5. Referral Links & Tracking
Upon approval, you will be assigned a unique referral link (“Referral Link”). Only referrals tracked through your Referral Link will be eligible for commission.
SwiftSites is not responsible for tracking failures caused by browser settings, cookie blockers, ad blockers, private browsing, user error, or modifications to the Referral Link.
6. Prohibited Conduct
You may not:
- Refer yourself or your own SwiftSites projects.
- Submit fake, misleading, incentivised, or low-quality leads.
- Engage in spam, cold outreach without consent, or misleading advertising.
- Impersonate SwiftSites or imply an employment, partnership, or agency relationship.
- Use paid ads bidding on SwiftSites brand terms without written permission.
- Violate any applicable law, regulation, or third-party rights.
7. Qualified Referrals
A “Qualified Referral” is a genuine new customer who:
- Was not already in contact with SwiftSites.
- Was referred via a valid Referral Link.
- Proceeds with a paid SwiftSites website project.
- Completes full payment for that project.
SwiftSites reserves the sole right to determine whether a referral qualifies for commission.
8. Commission Structure
Affiliates earn a fixed commission of €50 per approved website referral, unless otherwise stated in writing.
Commission is earned only after SwiftSites has received full payment from the referred customer. Website projects may take several weeks to complete and be paid.
9. Payment Terms
- Commissions are paid monthly.
- A minimum balance of €20 is required for payout.
- Balances below €20 roll over to the next month.
- Payments are made via PayPal to the email provided by the Affiliate.
SwiftSites is not responsible for incorrect PayPal details provided by the Affiliate.
10. Refunds, Cancellations & Non-Payment
If a customer:
- Fails to pay,
- Requests a refund,
- Cancels the project,
- Is refunded due to dispute or chargeback,
then the related affiliate commission will be voided or reversed. SwiftSites may deduct unpaid or reversed commissions from future payouts.
11. Customer Relationship
All referred customers are customers of SwiftSites. SwiftSites retains full control over pricing, communication, contracts, services, and business decisions.
12. Marketing & Representation
You may not issue press releases or public announcements regarding your participation in the Program without prior written consent.
You must not represent yourself as an employee, partner, or agent of SwiftSites.
13. Compliance with Law
You agree to comply with all applicable laws and regulations, including GDPR, privacy laws, advertising standards, and consumer protection legislation.
14. Termination
Either party may terminate this Agreement at any time, with or without cause.
SwiftSites reserves the right to immediately suspend or terminate accounts for fraud, abuse, policy violations, or reputational risk.
Upon termination, all unpaid commissions may be forfeited if violations are deemed material.
15. Limitation of Liability
SwiftSites shall not be liable for indirect, incidental, or consequential damages. Our total liability under this Agreement shall not exceed the total commissions paid to you.
16. Disclaimers
The Program is provided “as is” without warranties of any kind. SwiftSites does not guarantee referral conversion rates, earnings, or uninterrupted service.
17. Independent Contractor Relationship
Affiliates are independent contractors. Nothing in this Agreement creates an employment, partnership, joint venture, or agency relationship.
18. Governing Law & Dispute Resolution
This Agreement is governed by the laws of Ireland and the European Union.
Any disputes shall be resolved through arbitration under Irish law, except for intellectual property matters, which may be brought before a court of competent jurisdiction.
19. Entire Agreement
These Terms constitute the entire agreement between you and SwiftSites regarding the Referral Program and supersede all prior agreements or representations.
